Either:
1) He's lying about the sex, and this is aggrivated assault.
2) He's not lying about the sex, but this was actually a rape.
3) She agreed to have sex, and thus (IMO) baited him making the restraining order invalid.

So; I think the restraining order violation is probably the least of what's going on.
