That is not its purpose, that is what
does in pursuance of its purpose. Purpose includes an intent, and the WAP doesn't have one of its own.
A person who puts a server on the Internet can be construed to be serving the Internet. A person who puts a WAP in their living room can not be construed to be serving the whole neighborhood.

That's
exactly like saying if you leave your front door standing open, it's stupid to be angry if the public accesses your house. It may be technically true, but the people entering your house are still going to jail.
A door standing open is not a legal invitation to use, whether that door is physical or digital.
