I wonder if it's going to leave a permanent mark.

Thought that's technically not good enough--a principle of gun usage is to always assume it's loaded (even if you know it's not, the policeman you point it at might not).
We had an incident like this on campus one day when I was in college. I didn't hear about it, but I got the story from the police.

Apparently a random high schooler was wandering around the south end of campus flashing a gun at people. The police, of course, were called. He was kind a punk and stood in the middle of the road/parking lot area waving the thing around, occasionally putting it in his mouth for a few seconds at a time. The police were all over the place (I understand one car got air off a speed bump responding to this! The front wheels anyway.)

It took a few minutes, but the guy finally put the gun down and was swarmed and handcuffed. Upon inspecting the gun, it was discovered to be...a BB gun. The kid had the BBs in his mouth and was loading the BBs from the front end. It looked for all the world like a 9mil and could easily have gotten him shot, possilby killed. Needless to say he was in a lot of trouble for that.

I must say, anyone waving a gun around, real or not, loaded or not, is really trying hard to be an appropriate subject for this thread!
