I suspect the hardest part of any claim would be enforcing it.

I´d like to know the core of his arguments.

Since there´s a "de facto" ET real estate market amounting to some million (billion?) dollars, tribunals will have a hard time in the future.

Those only exist in places where people have rights. That is, they only exist in places where there are laws. In other words, not anywhere up there.

If Newton's laws apply up there, why not natural laws?

First, that supposes the existence of natural law. Second, squatters' rights are not a matter of natural law. They are a matter of statute.

Did you know that the framers of our declaration of independence actually were going to write "Life, Liberty, and Private property? but changed their minds? Personally I think they chickened out on that one. Private property should be an unalienable right, but alas http://en.wikipedia.org/wiki/Labor_theory_of_property
it remains only a theory.

Actually, the "Pursuit of Happiness" that they talk about is the pursuit of the fruits of one's labour. So, in a sense, they do mean property.

But, again, that only applies within the US.

The first people to build something there aren't going to want to give it up to whoever decides they have a legal claim on it.

In a sense, there would be a sort of natural property right for objects in space - nothing useful is up there until someone builds something on it. So until you build something on it, you don't own it. Once you do, you own the base you've built.

I have a feeling that these so-called property rights people have purchased in outer space will be legislated out of existence - with no compensation (why should there be?), when it actually becomes a pressing need. Until such time as we're actually landing on these bodies and able to enforce any property right we might have up there, there's really no point worrying about it.

If you're silly enough to buy something in outer space - because you actually think you'll gain ownership to it - then frankly you don't deserve any recompense in my book. A fool and his money are easily parted afterall.

I say we hit Mr. Dennis hope, of the Lunar Embassy, over the head with a wiffle bat, call it the first interplanetary war, and move on to more interesting things.

Whoever has the biggest guns and most soldiers is going to have claim to it, just like on Earth. Our wars will spill out into space *sigh*

Ding. Ding. Ding. Congratulations of being the first post to mention "wiffle bat" as an interplanetary weapon. I like your thinking. Keep up the good work.

Do you think we should run away and apologize from a safe distance afterwards?
